Anti-Commandeering Doctrine

In our first post we talked about Nullification to limit government overreach. BUT there is also another tool that we don’t hear much about. It is called: The Anti-Commandeering Doctrine. The one advantage to this doctrine is that the state does not have to prove constitutionality. Most legislators know nothing about Nullification and even less about The Anti-Commandeering Doctrine.

If you think the next election is going to fix everything I hate to disappoint you but the answer will not come from DC no matter who is in the White House. The only peaceful solution left is at the state level. And we must put something in place during the next legislative session especially before the WHA (World Health Assembly) meets again in May 2024 in which they will pass the amendments to the International Health Regulations (IHR) and the Pandemic Accord (they stopped calling it a treaty so they can circumvent Congress). They do not need any approval from Congress, Parliament or any other government of the 194 member states in the WHO to pass the amendments to the IHR because the IHR is already legally binding international law. If you have not been following this you really need to start because when passed the WHO will have total control over 194 countries. They can and will call anything a PHEIC (Public Health Emergency of International Concern). That includes the climate change hoax, transgenderism or leaves falling in the winter. Instead of making recommendations they will now make mandates. And it will cost the US many, many BILLIONS in American tax payer money to the WHO. It is also very possible they could pass some of the amendments during the current WHA which is taking place right now. They are proposing 307 changes to the IHR and there is talk that they may pass the digital ID, vaccine certificate, recovery certificate, testing certificate, travelers health declarartions, passenger locator forms, prophylaxis certificate this May (right now) instead of next year.

This is very informative and I thank you because I have never heard of anyone talk about the Anti-commandeering Doctrine. I do want to ask if "Nullify The WHO in South Carolina" would that be an example of this doctrine, HB 4246 on James Roguski substack on April 20 but I have not heard anything about how the state of South Carolina passed or failed? There is another push to use Article 5 to amend the Constitution with Mark Merkler, Mark Lavine and Glenn Beck for the last couple of years, and I am wondering if they have ever thought of the Anti-Commandeering Doctrine instead of Article 5 of the Constitution? However, my state is ruled by Socialist Democrats, changes laws without amending the states constitution, one party rule and have low information voters. Would these Blue States want to use this doctrine, after all, my state implemented the long COVID lockdowns and was slow to reopen?
