UPDATE ON NULLIFICATION BILL/GOLD-SILVER LEGISLATION UPDATE/TN INFORMER
Tuesday March 12, 2024
“You’ve got to get after your politicians and make them pay attention. If you get enough people calling all their legislators, then they’ll listen. I’ve seen one or two phone calls change a politician. Don’t underestimate the power of a phone call.” ~Senator Frank Nicely
First and most important; I want to thank everyone that worked so hard to support SB2775/HB2795. I know many of you made numerous calls and sent many emails and believe me they got the message. I thank everyone that took time from their day that drove to Nashville and attended the hearing today.
I watched the hearing today on SB2775 by the Senate State and Local Government Committee. A 1st (Sen. Briggs) and 2nd (Sen. Pody) were given. Senator Janice Bowling (the bill sponsor) gave an opening speech and then introduced Mr. Jeffrey Cobble as an expert witness. Mr. Cobble gave brilliant testimony in a very short time. It was obvious that members of this committee were humbled by the outpouring of support for this legislation. Sen. Briggs complimented the members of TNCSS that came to the hearing with signs for politely not holding them in the air out of respect for other spectators. Senator Pody asked Mr. Cobble to give his opinion on the AGs Opinion. He started to answer and after a minute or so he was interrupted in order to allow Sen. Lowe to ask a question because Senator Lowe had to leave the meeting. Senator Adam Lowe asked Mr. Cobble if Nullification would have allowed the state of Colorado to nullify the SC decision that CO could not remove a candidate from the ballot. Mr. Cobble answered they could not because the SC was acting within the enumerated powers given to the federal government. Sadly Senator Pody did not ask Mr. Cobble to continue with his opinion but instead stated he fully supported the bill and if Senator Bowling did not carry the bill he would BUT he believes this bill needs lengthy discussion and study. He stated that he believed the committee did not have the votes to move the bill forward. Mr. Cobble agreed with Senator Lowe that this bill is just the start of this nullification issue. The issue of case law v. constitutional law was mentioned on several occasions including in Senator Bowling’s opening statement. Senator Pody asked that the bill be moved to Summer Study and that the Summer Study would actually take place in May or June before campaigning got strongly underway. There were 3 no votes to move this bill to Summer Study. Senator Walley, Senator Yager and Senator Yarbro (not at all surprising). Senator Walley asked to clarify his NO vote. He said that he wanted to vote on the bill today and not send the bill to Summer Study. It was my gut feeling that Walley has turned around on this issue and would have voted YES. Senator Yager expressed the same reason as Senator Walley for voting NO on Summer Study. Of course Yarbro a Democrat who votes no on a lot of good issues brought before this committee gave no explanation which leads me to believe if a vote were taken he would vote NO.
We did not win the war but we definitely won the first battle. Last year this legislation could not even get a 2nd and died on the vine. This year we not only got a 1st, a 2nd we also turned a few of the Senators on the committee from a NO vote to a YES vote in support of this bill. We are going to continue all year to build our organization and strengthen our plan. David and I intend on attending the Summer Study. Senator Bowling made it clear this bill would be back next year. We have learned a lot this year. One thing I know; David and I will be more active in attempting to educate legislators and the public on this issue. We would love to get Mr. Cobble to conduct a training for legislators in Nashville at the start of the 2025 session when all legislators are in Nashville but before th bills start flowing. The left never gives up. They don’t care if it takes 50 years to get what they want. They keep at it and we must do the same. This issue is just that important and the bill will be back next year. Justice at times moves slowly but we need to continue to fight for our rights as a sovereign state and if our legislators are constitutionally illiterate we need to work to remedy that situation. Again, thank you so very much. This would never have happened without everyone that pitched in an supported TNCSS and our effort to restore the original intent of our Constitution and authority sovereignty in Tennessee not only for the current generation but for generations to come.
I will be setting up a ZOOM meeting with our TNCSS County Leaders for next week. I will send an email with the details.
I also watched the entire 2 hour Commerce and Labor Committee meeting because Senator Niceley was to present his gold/silver legislation. Due to time they had to adjourn the meeting right before Sen. Niceley’s bill came up. Stay tuned and I am sure Senator Niceley will give us an update tonight on TN Informer.

THANK YOU, Karen Bracken
It took a long time for forced annexation to be stopped. So nullification must be still pursued even harder.
Progress, however small, is good.
Appreciate you!
